The Terms and Conditions of Business ("the terms") apply in all cases where a service is provided to a client. Should there be any conflict between these Terms and any written agreement, the terms of the written agreement shall prevail.

It is your (the Employers) responsibility to undertake all checks prior to appointing such an Associate to ensure that they meet your requirements, expectations and qualifications suitable for the service required. If such work is referred to an Associate, any fees to be paid to Principal Surveying & Project Services Ltd in terms of a referral will be paid by the Associate to us as an introductory fee. Such fees are privately agreed between us and the Associate and are independent of any other fee arrangement agreed between you as the Employer and the Associate, and are not open for discussion or inspection.

JURISDICTION AND APPLICABLE LAW

DATA PROTECTION ACT 1998

We take the security and privacy of our clients and contacts about whom it holds personal information extremely seriously. Strict security procedures in the storage and disclosure of personal information given to us in order to prevent unauthorised access is taken. Personal Data is held on our contacts and administration database either because of work we have undertaken or are currently engaged in, or because our clients have indicated that they would be interested in receiving material from us about our business and services. To that end we hold client contact details and the history of our client relationship. This allows us to manage our client relationships effectively and target items of interest so that clients do not receive unwanted material through the post. In accordance with their rights under the Act, clients may request the amendment of the personal information held and to cease receiving direct marketing materials. We do not sell, rent or otherwise deal in the personal information we hold with third parties.

Should such transfer prove necessary, we will always ensure that the security and privacy policies which provide at least the level of protection afforded to data subjects in the United Kingdom.


TERMS OF BUSINESS

Principal Surveying & Project Services Ltd aims to provide a service stated in any written agreement. If no written agreement is present then the level set out in the duty of care below will apply. Any variations on this duty must be agreed in writing. No responsibility is accepted for items outside the scope of the service defined. No obligation is accepted to provide nor liability accepted for advice provided or failure to provide on the properties condition unless specifically requested to carry out a formal survey, security of property and the health & safety of those visiting a property.


We at Principal Surveying & Project Services Ltd owe a duty to the client to act with reasonable skill and care, to provide a service and comply with our client's instructions where the instructions do not conflict with these Terms, the Agreement or the applicable laws and rules of the RICS. To which we are not obliged to carry out any instructions of the client which conflict the above.


Principal Surveying & Project Services Ltd accepts no liability for any delay in or consequences for failure to provide the services or any failure by the client or client's agent to promptly provide any information that Principal Surveying & Project Services Ltd reasonably requires, or where information provided is inaccurate or incomplete. The client agrees that where information is provided Principal Surveying & Project Services Ltd are entitled to rely on it as being accurate. If the client decides not to follow the advice or recommendations, Principal Surveying & Project Services Ltd puts forward, Principal Surveying & Project Services Ltd accepts no liability or responsibility.


Remuneration - Where the service is not performed in full, Principal Surveying & Project Services Ltd will be entitled to a reasonable fee proportionate to the service provided as estimated by Principal Surveying & Project Services Ltd.


If an invoice is not paid in full within 30 days (or as stated in the individual terms on any written offer of intended services), Principal Surveying & Project Services Ltd may charge interest on the balance due at the rate of 8% above the Bank of England base rate current at the date of the relevant fee account.


Where delivery of any invoice has been made by Principal Surveying & Project Services Ltd and payment of such invoice is not made within the payment terms, you agree to pay all costs, including letters requesting payment, legal costs and disbursements incurred collecting or securing, or attempting to collect or secure the payment of the invoice, such being time charged at the current hourly rate of £87.50/hr Principal Surveying & Project Services Ltd are not obliged to undertake all of the services offered or accept instructions all of the time. In the event that we cannot undertake a service we shall advise the client immediately and before any work is undertaken.


We may recommend that some services are referred to other professionals or an independent 'Associate' Company that we work independently alongside. You are under no obligation to accept their services and we shall act only as an introducer. In such cases where you agree to appoint/instruct an 'Associate' and work is undertaken by them on your instruction, you will be bound by their own business terms and conditions of service. Principal Surveying & Project Services Ltd will accept no responsibility in connection with the services they offer and/or provide. It will be the Employers/Clients responsibility to undertake all checks prior to appointing such an 'Associate' to ensure that they meet your requirements, expectations and qualifications suitable for the service required.


If such work is referred to an 'Associate', an arrangement may be in place whereby a fee is paid to Principal Surveying & Project Services Ltd by the 'Associate', in terms of an introductory referral fee or commission, dependent on any such arrangement between those two firms (if applicable) Such fees are privately agreed between Principal Surveying & Project Services Ltd and the 'Associate' to which the Employer/Client has no liability, and are independent of any other fee arrangement agreed between you as the Employer/Client and the Associate, and are not open for discussion or inspection.


Principal Surveying & Project Services Ltd owes no duty of care and has no liability to anyone but their client, unless specifically agreed in writing by Principal Surveying & Project Services Ltd. No 3rd party has any rights under the Agreement unless agreed in writing. Principal Surveying & Project Services Ltd has no liability for products or services that it reasonably needs to obtain from others in order to provide the service.

VARIATIONS

We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our site.
